National Regulatory System

Development of a National Regulatory System for Community Housing


In June 2011, Housing Ministers across Australia agreed to develop a national regulatory system for community housing.  The proposed system seeks to introduce nationally consistent regulatory arrangements to promote the growth of the community housing sector nationally.

 

The new system will aim to:

  • Improve tenant outcomes and protect vulnerable tenants
  • Protect government funding and equity in the sector
  • Enhance investor and partner confidence

    Public Consultation on the proposed system closed on 20 January 2012. The Report of Public Consultation (PDF, 500KB) for the proposed National Regulatory System for community housing and a letter to stakeholders (PDF, 22KB) is now available. Feedback from consultations and public submissions will allow stakeholder input to be incorporated into the draft legislation, which will be put to Ministers for approval in 2012.

    Background

     

    In April 2010, the Australian Government released a public discussion paper, Regulation and Growth of the NFP sector, which proposed potential options for regulation and growth of not-for-profit housing providers in Australia.

     

    The NSW Government prepared the NSW Govt Response to Discussion paper (PDF file, 263KB) to the discussion paper and has been working with the Commonwealth and other States and Territories in the development of a national regulatory system for community housing providers.

     

    In February 2011 Housing Ministers agreed to introduce an Applied Law scheme for the national regulatory system.  The National Law will be enacted firstly in the host jurisdiction, New South Wales, and either applied or adopted thereafter by other jurisdictions.
